Probation period is regulated in article 15th of Turkish Labor Law. It is regulated that there should be maximum 2 months of probation period in labor contracts. This probation period could be extended to maximum 4 months in collective labor contracts. ın such period, both parties may terminate the contract without a cause and without compensation. However the wage and other rights of the employee are reserved for the labor contract which is terminated in the probation period. ıt should be noted that regular employment contracts do not include probation period and it should inserted accordingly. the probation In the event that no probation period is determined, employee shall be granted to notification pay in case the employer terminates the contract in 2 months period.
In Turkish law, there is no discrimination between Turkish employees and foreign employees working in Turkey (expats). In other words, the foreign employee has the same rights with the Turkish employee.
